“2024 Topps Series 2 Social Media Follow B@ck Redemption Card Program”

THESE OFFICIAL RULES (“OFFICIAL RULES”) PROVIDE THE TERMS AND CONDITIONS OF THE 2024 TOPPS SERIES 2 SOCIAL MEDIA FOLLOW B@CK REDEMPTION CARD PROGRAM (THE “REDEMPTION PROGRAM”). BY ATTEMPTING TO PARTICIPATE IN THE REDEMPTION PROGRAM, PARTICIPANTS (AS DEFINED BELOW) FULLY AND UNCONDITIONALLY AGREE TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF TOPPS, WHICH WILL BE FINAL AND BINDING IN ALL MATTERS RELATING TO THE REDEMPTION PROGRAM.

  1. Eligibility. Participants (“Participants”) must be legal residents of the 50 United States or the District of Columbia who are 18 years of age or older (or of legal age of majority in state or province of residence), or 13 to 17 years of age with a parent or legal guardian consent. Void in Canada, outside of the 50 United States and the District of Columbia, and where otherwise prohibited or restricted by law. Participants must have a valid, active, and public Instagram.com account and comply with all applicable terms, conditions, policies and requirements of Instagram.com. Employees who were responsible for the administration of this Redemption Program, officers and directors of The Topps Company, Inc. (“Topps” or “Sponsor”) are not eligible to participate. Employees, officers and directors of the Player Entities (as defined below), the MLB Entities (as defined below) and each of their respective parent companies, subsidiaries, and affiliates are not eligible to participate. For purposes of these Official Rules, (i) the “MLB Entities” shall be defined as , the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P., Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), and each of their parent, subsidiary, affiliated and related entities, any entity which now, or in the future, controls or is controlled by, or is under common control with the Clubs or the BOC and the owners, general and limited partners, shareholders, employees, directors, officers, and agents of the foregoing entities, and (ii) the “Player Entities” shall be defined as, collectively, the Major League Baseball Players Association (“MLBPA”) and MLB Players, Inc. (“MLBPI”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with MLBPA and/or MLBPI, and the owners, general and limited partners, shareholders, directors, officers, members, employees and agents of the foregoing entities, including each and every Major League baseball player.
  2. Overview. Sponsor will include up to 221 “follow b@ck” redemption cards throughout the entire 2024 Series 2 product line (each, a “Redemption Card”) featuring different participating professional baseball players (each, a “Participating Athlete”) that will allow Participants the opportunity to receive a “follow” from the Participating Athlete on the Participant’s Instagram profile for up to one year. As further detailed herein, Participants expressly acknowledge and agree that:
    • SPONSOR DOES NOT GUARANTEE THE PARTICIPATION OF THE PARTICIPATING ATHLETE FEATURED ON A PARTICULAR REDEMPTION CARD AND SPONSOR MAY REPLACE OR SUBSTITUTE ANY PARTICIPATING ATHLETE WITH ANY OTHER PROFESSIONAL ATHLETE OR ALTERNATE PRIZE AT ANY TIME FOR ANY REASON.
    • ANY INTERACTION BETWEEN A PARTICIPANT AND A PARTICIPATING ATHLETE IS NOT GUARANTEED OR OFFERED AND AT THE SOLE DISCRETION OF THE PARTICIPATING ATHLETE.
    • PARTICIPATING ATHLETES MAY UNFOLLOW ANY PARTICIPANT AT ANY TIME FOR ANY REASON INCLUDING, WITHOUT LIMITATION, BASED ON A REDEMPTION HOLDER’S SOCIAL MEDIA ACTIVITY.
    • THE MLB ENTITIES, PLAYER ENTITIES AND INSTAGRAM ARE NOT SPONSORS OF AND NOT RESPONSIBLE FOR THE REDEMPTION PROGRAM.
  3. Odds; Alternate Means of Entry. Chances of receiving a Redemption Card with purchase of a 2024 Topps Series 2 product are approximately:

    • Fanatics Box: 1:75,120For a chance to obtain a Redemption Card without purchase, at the same odds, while supplies last, hand print your name and complete address on a 3 x 5 card and mail in a #10 envelope to: 2024 Topps Series 2 Follow B@ck, P.O. BOX 852168, MESQUITE, TX 75185. Only one card per envelope, mailed separately, postmarked by September 11, 2024, and received by September 18, 2024. No metered mail. Limit 1 request per household for the Redemption Program. Failure to comply will result in all entries disqualified. Drawings to determine whether entrants receive Redemption Cards or not will occur on or about September 25, 2024.
  4. Redemption Period. The Redemption Program will commence on June 12, 2024 and ends 11:59:59 Eastern Standard Time on June 12, 2025 (the “Redemption Period”).
  5. To Participate. To participate, Participants must redeem a Redemption Card during the Redemption Period by scanning the QR code or by visiting https://www.topps.com/pages/promotions/s2socialmediafollowback and enter the scratch off code each located on the back of the Redemption Card where directed. Participants will be required to login to their Topps.com account or create a new account.Limit one redemption per Participant. Additional redemptions will be disqualified. Further, each Redemption Card may only be redeemed one time and redemptions are non-transferrable. Redemption cards are void after the Redemption Period, if the scratch off code is damaged or illegible, or if not redeemed in accordance with these Official Rules. All entries submitted in accordance with these Official Rules shall be hereinafter referred to as “Eligible Redemptions”. There is no cost to redeem a Redemption Card, however internet access charges and/or wireless data rates may apply.Participants with Eligible Redemptions (“Redemption Holder”) must comply with all terms and conditions of these Official Rules including, without limitation, the eligibility requirements set forth in Section 1 above. Redeeming a Redemption Card is contingent upon fulfilling all requirements. In order to complete the redemption of an Eligible Redemption, after entering the scratch off code in the applicable webform, Redemption Holder must sign and return to Sponsor, within 48 hours after receipt from Sponsor, an affidavit/declaration of eligibility and liability/publicity release (except where prohibited by law), or any other document necessary to confirm eligibility, including consent from a parent or guardian (if applicable), as determined by Sponsor, in its sole discretion. Sponsor reserves the right to conduct a background check on the Redemption Holder, which may also include a review/monitoring of all of Redemption Holder’s social media accounts, and Sponsor reserves the right in its sole discretion to disqualify any Redemption Holder based on the results of such background check or if, at any time, the Sponsor or Participating Athlete determines, in its sole discretion, that providing the redemption to the Redemption Holder might reflect negatively on Sponsor or its Participating Athlete.Sponsor is not obligated to share any specific results of background check with any Redemption Holder, whether the background check resulted in a disqualification or not. Factors that could result in disqualification include, without limitation, having been convicted of a felony or misdemeanor, being delinquent on a government-ordered payment, such as child support, spousal support, alimony, tax payments, etc., or any other criminal or civil offense determined at the sole discretion of Sponsor. Where necessary to fulfill this requirement in any jurisdiction, Redemption Holder must provide authorization and/or complete any forms reasonably required to facilitate such background check. If any Redemption Holder cannot be contacted within 48 hours after the first attempt to contact him/her, or if he/she fails to sign and return the required documentation within the required time period, such Redemption Holder’s Eligible Redemption is void at Sponsor’s sole discretion.
  6. General Terms. Arrangements for redemption of the Redemption Cards will be made by Sponsor. All details related to the Redemption Program not specified in these Official Rules shall be solely determined by Sponsor. Participants are required to comply with any and all applicable federal, state, and local laws, rules, and regulations. Sponsor shall have no responsibility or obligation to any Participant or Redemption Holder, who is unable or unavailable to accept or utilize a Redemption Card or Eligible Redemption as described herein. No substitution, transfer or cash equivalent is permitted, except by Sponsor in its sole discretion, in which case a replacement of comparable or greater value may be provided with such value determined by Sponsor.Noncompliance with any of these Official Rules, in Sponsor’s sole discretion, may result in disqualification.Indemnified Parties (as defined below) assume no responsibility for incorrect, inaccurate, or late entry information whether caused by any of the equipment or programming associated with or utilized in this Redemption Program or by any human error which may occur in the processing of theRedemption Cards in this Redemption Program. Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Redemption Program or Official Rules for any reason, including if the Redemption Program is not capable of running as planned, including, without limitation, unauthorized intervention, fraud, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Redemption Program or amendment and/or adoption of new or existing laws and/or regulations regarding the administration, operation or any other aspect of the Redemption Program in any jurisdiction. Should the Redemption Program be terminated prior to the stated expiration date, Sponsor may allow Eligible Redemptions to be redeemed to the extent received up until and or after (if applicable) the time of modification, cancellation or termination or in a manner that is fair and equitable as determined by Sponsor. All interpretations of these Official Rules and decisions by Sponsor are final. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE REDEMPTION PROGRAM MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE NEW YORK COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE REDEMPTION PROGRAM AND THE LAWS OF THE STATE OF NEW YORK SHALL GOVERN THE REDEMPTION PROGRAM. EACH PARTICIPANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS. Participants agree to indemnify and hold harmless Sponsor, Participating Athlete, the Player Entities, and the MLB Entities and each of their respective affiliated companies, parents, subsidiaries, officers, directors, employees, agents, members, successors and assigns (collectively, the “Indemnified Parties”) from and against any and all liabilities, claims, suits, losses, damages, expenses and costs (including, but not limited to reasonable attorneys’ fees) resulting or arising from: (a) the Redemption Program, including Participants participation therein, and/or (b) any breach or violation of any representation, warranty, obligation or covenant made by each Participant herein. Further, each Participant agrees to, and hereby does, release all rights to bring any claim, action or proceeding against the Indemnified Parties, to release all rights to bring any claim, action or proceeding against the Indemnified Parties, and hereby acknowledge that the Indemnified Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Redemption Program.BY ENTERING THE REDEMPTION PROGRAM, PARTICIPANTS RELEASE AND HOLD HARMLESS THE INDEMNIFIED PARTIES FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE REDEMPTION PROGRAM OR PARTICIPATION IN ANY REDEMPTION PROGRAM-RELATED ACTIVITY, AS WELL AS CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY.IN NO EVENT WILL THE INDEMNIFIED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ARISING OUT OF ANY ACCESS TO, LACK OF ACCESS TO, AND/OR USE OF THE REDEMPTION PROGRAM WEBSITE, THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE REDEMPTION PROGRAM WEBSITE, THE REMOVAL FROM THE REDEMPTION PROGRAM WEBSITE, OR DISCONTINUATION OF ACCESS TO, ANY MATERIALS, OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF, OR PARTICIPATION IN, ANYTHING RECEIVED IN CONNECTION WITH THE REDEMPTION PROGRAM.WITHOUT LIMITING THE FOREGOING, THE REDEMPTION PROGRAM, TOPPS.COM, AND ALL RELATED ACTIVITIES AND MATERIALS PROVIDED ON OR THROUGH THE REDEMPTION PROGRAM ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  7. Use and Transfer of Personal Information. By participating, each Participant agrees that their personally identifiable information collected or used in connection with the Redemption Program may be used by Sponsor in accordance with its privacy policy located at Topps.com/pages/privacy-policy. Any personal information held by Sponsor in connection with the Redemption Program will be held on record for a reasonable period to fulfill the purpose for which such personal information was collected. If a Participant gives Sponsor permission to pass on their personal information to a third party then this shall no longer be the responsibility of Sponsor and shall be subject to the privacy policy of that third party.
